As reported on the kniakrls.com web site-- "status of the liquor license for the Dingus Lounge will be discussed at this coming Monday meeting of the Knoxville City Council". It might possibly be suspended because of a couple recent situations of being open after the City stipulated closing time.

The Knoxville City Council will consider suspending Dingus Lounge’s liquor license during their regular meeting Monday. According to a city memo, the Knoxville Police Department found patrons in the establishment two separate times after 2:10am. City Code stipulates that non-employees may not be in licensed liquor establishments between 2am and 6am. One of those two times, open containers were still visible. According to that memo, patrons stated they were waiting for a ride from employees who were closing. Dingus had its license suspended for four days after a similar incident in 2006. However, that suspension was waived after the business went a year without a further incident.

There is a HUGE difference between suspending their liquor license and not renewing it.

The bottom line is this, AJ and his crew know what the STATE law is (this is not a city issue). THey violated and got caught by allowing patrons to stay in the bar and have open containers after 2:00 AM.

To remedy the situation, all they have to do is make sure there are no open containers and make sure patrons are outside the door by 2:00 AM.

If the city decides to do something, my guess is that it will be a short suspension as when you look at the bigger picture they really don't have any issues (the cops don't get called about fights, drunks in the street, serving underage patrons, etc., etc.).

Even if the city does suspend their liquor license (for lets say a month), that still puts them opening back up prior to the race season (which is when 99.9999% of the people on this message board might actually go there....

City Council tabled the discussion until their next meetin on March 4.

My gut tells me they may get a week suspension, but more than likely it will be waived due to the lack of complaints at the Dingus (considering the "reputation" of Dingus during race season as well as when I was much younger, the cops are rarely (if ever) called for a disturbance at Dingus (you can't say that about most bars in ANY town).

There will be a loss of $$$$ from Taxes, a fine would be better.

On two consecutive days in December, police officers did bar checks and found patrons in the Dingus at about 2:10am, breaking a city code that prohibits non-employees from being in such a licensed-liquor establishment after 2:00am. Owner A.J. Mottet and other Dingus employees testified that those patrons were waiting for employees to give them rides home. Mottet admitted he had broken city law, but asked that the Council impose a fine rather than suspend their license so his employees were not negatively affected.

Dingus faced a suspension of up to 10 days or a fine of up to $1000. A motion was first made to fine Dingus $300. That motion was rejected by a 3-2 vote with Councilors David Roozeboom and Tim Pitt voting for it and Councilors Carolyn Formanek, Elsie Kemp, and April Verwers voting against it. Another motion was made to suspend Dingus’s license for ten days. Verwers voted for that, while Formanek, Kemp, Roozeboom, and Pitt voted against it. The final motion was a fine of $1000; All but Pitt voted to institute that fine.

Maybe the folks that were there after 2:00 were just helping clean up, putting chairs up on the tables, sweeping etc...

They weren't (those in the bar after 2:00 stated they were waiting for a ride from someone working there to the police).

All they had to do was walk outside @ 2;00 and no fine or anything for Dingus.

Anyone that has ever been at a car at closing time knows how the bartenders and such are grabbing beer bottles and glasses off the tables as fast as they can (it's not new).
