I left at 12:30 to resume at 1:30 I tink it is a toss up. Great testimoney by Duke Hill, Kevin Pickard.,

Was there any mention of the dollars already invested by racers this year, and the impact of the late announcement of the closing?

That was the strongest argument. They are really pushing that it is a saftey issue and would you put your family at risk. ( Bull Shit )

Been putting myself and my family jewels at risk since at that track since 1969, just as I put my family at risk everytime I drive I-40 or when we go out to eat as a family.

Judge Owens will give each side 30 minutes to testify tomorrow starting at 1:30. Bottom line is: who is responsible for the insurance if someone gets hurt in the grandstand, and with the safety issues presented by the City, if we can even get insurance. The judge said why is this a serious issue now if it wasn't an issue 50 years ago, but he said if he allowed it to stay open, sure enough someone would be injured this season. It looked pretty good for us until the insurance issue came up. Lanny's lawyer did a good job on the electrical contractor from the city, and on O'toole from the fair board. Good testimony from Duke Hill, Dutch, Lee Little, Mark Brill, Kevin Pickard.

Guys we really to see a return of everyone and hopefully more if we could. The judge knows this directly effects all of us and we need more drivers if possible! This is pretty crucial and would be great to have in our corner! I've been asked to do this and we cannot give up or give in as we have a legitimate shot at this!

Wish I could have been there today & tomorrow but can't get off work. Was there anything brought up about the economic effect this has on business'? Glad to hear its going as well as expected.
