So the story goes that Lanny was not given the opportunity to renew his lease. Almost any lease I've ever read gives the tenant the right to renew automatically unless the tenant gives written notice within said time of the expiration of the lease. Has anyone ever seen this lease that Lanny signed with the City? It should be a public document. Its most likely been filed with the County Clerk (most any legal documents in which a municipality is a party of interest must be recorded there.)

All I'm saying is that there's a chance that the City must give Lanny the right of renewal. If this clause were not in place, each year you could have a new promoter, as the City would have to accept bids. But this clause is the reason that parties continue to have these leases/contracts/agreements-it protects the lessor's (Lanny's) interests in the track.

If the City must give Lanny the option to renew, as defined in his 2009 lease, then the City must also make said repairs to the electrical system.

If the truth was known Lanny probably turned it down IMO... Being he is in his 70's and to much political BS and they want to close it in the very near future anyway. He has been running race tracks long enough to see the wrighting on the wall. It's sad to say but it is probably what happened IMO.

Ok I had a rather lengthy phone conversation last night about state fair speedway and there is still a chance of a race season in 2010. Lanny did not have a choice on the lease, he found out right before the banquet that they would not renew it. I also heard that "they" im guessing that is the fairboard called the ADA in to check things and file a lawsuit against thereself, while the grandstands are not up to todays standards, they do or should however fall under a grandfather clause. I know that Lanny is meeting with people and trying to make this happen.

Thanks that's some good news, it's nice to admit that I was wrong on my reply. Maybe there is some hope for a fairwell season after all.

Very rarely do you have to bring infrastructure into ADA compliance without some kind of happening on your own behalf. What I'm saying is that if you owned a beer bar and decided you wanted to get a liquor license, upon your application, your bar would have to be made ADA compliant. If you try to get your property rezoned, you're going to have to make it ADA compliant first.

And another thought I had regarding the electrical system...did the City or the promoter install the lighting and wiring in question? If the City/FairBoard built it as it is today, it's their responsibility to repair it, because let me assure you, if the lines are really just "laying atop the grandstand" as has been indicated, this was NEVER up to any buildings and standards code!

Im willing to bet that its all done by whomever the fairboard hired to have it done. Now they want it gone. The politicians are nothing more than ball sucking maggots. I hope everyone takes names and votes everyone out of office that helped get the speedway to this point.
