A) THC can stay in your system up to a month, its mere presence is no proof kid was high

B) Kid is dead, family has been paid off, we can't read Tony's mind... can we just drop this?



When this went in front of a grand jury I believe the toxicologist was on record saying there was enough in his system that he would've had to have smoked that day.

I could be wrong, but since Ward spun out without contact from Tony, I have always contended that Tony didn't even know Ward was mad at him when he came back around under caution. He was as surprised as anybody when Ward came toward him. It wasn't like Tony stuffed him in the wall and was expecting some sort of retaliation.



I agree that Stewart's car never touched Ward's car and Tony never knew Ward was looking for him. The kid wasn't smart enough or have the ability to get out of the throttle because he was high. He then gets out of his car in a dark drivers suit on a dimly lit racetrack, then he walks to a spot on a sprint car that he should know is a blind spot. He obviously wasn't thinking clearly. He had no business being in a race car. 

The Ward's lost their golden egg when they found out Kevin's girlfriend was having someone else's baby. That may sound harsh but they are  facts. IT was always about the money.

You're wrong on point A Jim.    If a urine test shows presence of it then that means you've smoked it in the last month or so.   If the resuults were from a blood test, that shows what was in the body at that time.   

 

As for point B - I agree completely.    



They blood tested his corpse?

Yep.   It's called an autopsy Jim.    They draw blood and have to wait for toxicology tests to come back.   That's what they do with dead rock stars and why they sometimes don't announce an official cause of deaths until weeks after it happened.

You must be all-knowing, somehow. The Wards clearly stated they weren't after money as result, but rather some culpability on the Stewart side. FFS, it's the lede of the story. 

They felt their best chance was to accomplish this was to get a top shelf law firm with a proven track record. Does the law firm care about the money? Yes, that's their job. So yes, if your post meant to point out the fact that the law firm representing the Wards was "about the money", then you're dead on. But the Wards have clearly stated that it wasn't their primary motivation.



Your kidding right? if it's not about the money are they donating it? I DOUBT IT!!! the kid is dead because of his stupid actions

You do understand the only way you can get a top tier law firm to work on contingency is for there to be a large settlement at the other end, right?

I don't care how grainy the video was, Kevin did not get run over, he attempted to jump on and ride on the car, he slipped off and got hit by the right rear, it's visable on the you tube video. Kevin did this all by himself. Every driver, except Zemken, said the same thing, there is no way Tony could have seen him or known that Kevin was going to try to jump on and ride on the car to get Tony. I'm shocked that anyone could watch that video and believe anything else. He literally runs down the track and attacks the car. So yes, I can say with 100% confidence that Kevin Ward is the only one at fault in causing his own death.

So if there was no way Tony could have seen him, how does that explain the rear end breaking loose right as he comes to Ward? Again, that easily could have been evasive maneuvering, but he obviously saw him at some point... unless it just so miraculously happens that Smoke was buzzing the tires at that point - what a coincidence, huh?

I'm shocked that anyone could watch the video and say that Tony is 100% without a shadow of a doubt free of fault. There was fault on Ward, and that percentage goes anywhere from 0-99%, don't get me wrong, but Stewart gets some of that blame as well.

If it's as much of a slam dunk that you all seem to think it was, why did his legal advise him to settle? Someone should give him a call and let him know that he wasted money on the settlement, because the braintrust of Hoseheads says you're in the clear, Smoke!

I get that this was a big negative for sprint cars and not attraction the sport needed or needs, but take the fucking blinders off for a second.

Why did Smoke settle?   Because it's much easier that way, and for the same reason the large company that I work for will pay settlements when they could probably win in court.    Sometimes it's cheaper that way and not only easier.   Sorry if you don't believe Ward is 100% responsible, but the fact that his momma said it wasn't about the money and you believed it tells me much about the way you think.

For Crimeny Sakes!

Kevin Ward is dead.  He had fault and the vast majority of it!  He stays in his car and doesnt act like a whiney snively brat because something bad happened on the track hes alive and kicking rooster tails of dirt in the air in his winged sprint today.

Tony Stewart has some fault in the deal...My work has me driving a lot and our company policy is, no matter the case in an accident, if your vehicle is in motion you have some fault. Did Smoke see Ward? We will NEVER FRICKEN KNOW! Why did Tony settle? See Dryslicks most recent post. Simple as that.

Did the Ward family do it for the Dinero. Dont think for one second it wasn’t about the dough. Why the hell else does anyone sue.

Either way....its done, its over...the horse was beaten and dead long ago. I get sick of being sucked into this post every time. And yes, i could not look at it but its the damn trainwreck syndrome. 

Rant over...lets talk about racing.
